On 19 February 2020 WEBER & Co. invited to the law firm’s seminar series RECHT FRÜH. The numerous participants and the lively participation showed perfectly how important leasehold (“Baurecht”) has become due to the housing shortage and the price increases. The Austrian legislator should adapt the leasehold (“Baurecht”) to the challenges of the 21st century.
The Austrian leasehold (“Baurecht”) was enacted over 100 years ago with the purpose to mobilize building land. Some legal provisions are very rigid and cannot be modified by the contracting parties. The lack of flexibility and the unclear legal link between leasehold (“Baurecht”) and condominium ownership are the main points of criticism. The seminar offered an update on the general conditions as well as possible solutions.
